Hi, I'm in the US, and have a product/company name which I'd like to register. I'm trying to decide which route is better for me. I think with plenty of research and advice from others, I can fill out the forms correctly etc, but what I don't think I can do myself is perform a common law trademark search. So what is my risk of moving forward without hiring a company or lawyer to do this for me? Will the USPTO's search find a common law trademark which prevents my claim and so I risk only the possibility of being denied and thus only the filing fee? Or is there a likelihood that they government's research can miss another company's common law trademark and register my name anyway and open myself up to legal problems? Are there any other risks I'm not thinking about?
