Professional Advice Badly Needed!

    Hello, first of all, it's good to be back here! Been a long time since I made my last post. I'm here to ask for help from you guys. I don't really know if this is the right place to post this. So Moderators, please transfer this thread to the right spot if this is not the right place.

    This is my story:

    I am Eureka (Not my real name). I just recently worked with an insurance company in the US (as a lead generation specialist). I had a deal with the owner of this life insurance company that he would be paying me with X amount of money if I manage to deliver a certain amount of leads to his company. Though he will also pay me with the agreed rate based on the number of leads that I will deliver If ever I was unable to reach the quota within 2 months. After a long talk, the campaign was launched.

    I consulted one of the best online marketers in the Philippines and he taught me a system that would find and filter warm leads of almost every industry in the search. I worked day and night. After 2 months I was able to deliver the agreed number of leads to my client (see attached screenshot as example). I was sending him the report every other day to secure the leads that I found.

    This is the problem. He said that there's only 15% of the total leads that were converted into sales after two months and that we would only be paying me according to the number of sales made. This was the thing that drove me super crazy! There's nothing in the agreement that says he will pay me depending on the number of sales! We only talked about leads! He sent me the payment according to the sales which we didn't even agree on. I was so disappointed (To be honest I wanted to find and kill that man if I were just a few blocks away).

    I was so down. Because I am planning to put up my own business and I am badly in need of capital right now. I did not spend sleepless nights to learn the system and deliver the leads to get scammed by this man!

    Now, If there's any possibility, how can I get that man to pay me the right price we have agreed on? :( any answer would be greatly appreciated. Thanks and Take care folks!

    Hey Eureka, your concern is genuine. I feel you need to consult a legal advisor with an experience in such online business cases. He can advise you on this breach of contract issue depending on your country's law.

    Thanks Vikram, I think I have to dig in a little deeper on this because my client is in the US and I'm from Philippines.

    Do you have a written contract that makes everything easy to understand? and do you have clear evidence of how many leads were generated and how?

    If the answers to both of these are yes then you should start by sending a polite but firm written request to the company for full payment as per contract. Stating that you will seek legal advice.

    If you want to push for payment then you would have to seek advice from someone within the state that the company is based as I am assuming any contract would have been signed based on US law (and that state). You may be able to find someone who is willing to work on a % rather than flat fee (if the $ are enough to justify their work). However, this may well be a long and stressful process.

    Thanks for this. Yes. I have a written contract and a clear evidence of the leads I made and how I made it (similar with the attached image). thank you very much. I will take note of your suggestion.
