Have Corp or Corporation in Name - But Actually an LLC

    Okay guys, I am curious about something. We are thinking about making a business...for example called...."The Smith Corporation"....however, it is going to be structured and an LLC (as they are easier to manage)....is this considered false advertising? or is it illegal? or is it misleading? or is it something people frown upon?

    We are wanting to get the general public's view point on it.

    I don't see what the issue is personally. However, some people in the industry might (keyword:might) frown upon it. Regardless, keep in mind your business title/name would then be "The Smith Corporation, LLC". I've seen it done plenty of times and like I said I wouldn't worry about it. At the end of the day based on what your LLC does and how many partners it has you can also file as an S Corp or Regular Corp even if you're filed as an LLC.
